A truck driver has been indicted on a charge of criminally negligent homicide in connection with a Tioga County crash that resulted in the death of a highway worker.

A grand jury indictment naming 37-year-old Lawrence Faucett of Ulster, Pennsylvania was unsealed Monday morning.

Authorities have said Faucett was the driver of the truck that slammed into a New York State Department of Transportation vehicle on Route 17 in the town of Nichols March 13.

45-year-old Dennis "Matt" Howe of Candor was seriously hurt in the crash. He died of complications related to his injuries five days later.

Faucett was arraigned before Tioga County Court Judge Gerald Keene.

John Stevens, an Ithaca attorney representing the Bradford County man, entered a not guilty plea for his client.

District Attorney Kirk Martin told the judge he would not seek bail for Faucett.

Stevens said Faucett had been a driver for the Dimon and Bacorn moving company for more than 12 years. He also said Faucett's wife is an attorney and he has a five-year-old son.

After the arraignment, Stevens said "this was a tragic accident." He said he believes Faucett will be exonerated.

Judge Keene released Faucett on his own recognizance. Motions in the case are due on May 30.
