An Owego man will be sentenced in February after admitting he broke into a Washington Street, Binghamton apartment in August and stole computer equipment and a credit card.

The Broome County District Attorney’s office reports 36-year-old Randy Buck Junior of Owego appeared in Broome County Court November 21 and entered a guilty plea to a felony count of Burglary in the Third Degree in the August 7, 2022 incident.

Prosecutors say following the theft from the apartment, Buck reportedly used the stolen credit card to make purchases at unspecified businesses located in the Oakdale Mall in Johnson City.

Authorities say Buck had a prior felony conviction in 2014 in Chenango County for Criminal Possession of a Controlled Substance in the Fifth Degree.

The news release from the Broome County District Attorney’s office did not indicate if Buck had served any time in prison for the previous conviction.

Criminal Possession of a Controlled Substance in the Fifth Degree, however, is a Class D felony carrying a possible sentence of up to seven years in prison according to New York State Penal Law. It is the lowest degree of felony drug possession charge in New York.

Burglary in the Third Degree is also a Class D Felony, the lowest tier of burglary charges.  The charge carries a maximum penalty of seven years in prison.

District Attorney Michael Korchak issued a statement regarding Buck’s previous record and the latest plea. Korchak said: ”Defendant Buck’s criminal history shows a disregard for the rules of a civilized society.”

Buck is to be sentenced to two to four years in New York State Prison.  Sentencing has been tentatively set for February 23, 2023.
