A Cortland County man is charged with vehicular homicide and other counts in connection with the death of a child in a crash near the Virgil Fire Department April 24.

Cortland County Sheriff’s officials accuse 29 year old Daniel Haynes III of Virgil of driving at a high rate of speed on West State Road at about 8:45 p.m. when he lost control and the vehicle hit a utility pole before coming to rest on the shoulder.

Authorities say beside Haynes, there were two adults and three children ranging in age from six to ten in the vehicle.

All of the children were taken to hospitals and one died as a result of their injuries.

Haynes is charged with felony aggravated vehicular homicide, four felony counts of reckless endangerment, three felony charges of aggravated drunk driving under Leandra’s Law, unlawful possession of marijuana, three counts of endangering the welfare of a child, failure to stop at a stop sign, speeding, failure to keep right, driving over hazard markings, consumption of alcohol in a vehicle, reckless driving, two counts of children between the ages of 8 and 15 not buckled in and one count of no seat belt for a child between the ages of 4 and 7.

Sheriff’s investigators say the road was closed for about five hours following the crash.

The incident is still under investigation and officials say more charges are possible.
