The former recreation director in the Village of Waverly admits he altered and destroyed Village Recreation League documents to cover up his misappropriation of funds.  

New York State Comptroller Thomas DiNapoli’s office has announced that 67-year-old David Shaw of Sayre, Pennsylvania pleaded guilty to official misconduct, confessing he misappropriated $16,525 in village funds. He has been sentenced to one year conditional discharge and has paid restitution.

According to a news release from the Democratic Comptroller's office, Shaw was responsible for collecting funds for child sports registrations, fundraisers, tournaments and field trips.

Shaw had served as the recreation director at the village since 2015.

A review of the recreation records found that Shaw had no problem regularly collecting the cash funds but failed to deposit everything in the Village of Waverly accounts.  The Comptroller's office says it found between November 2015 and August 2019, there was $16,525 in payments that were unaccounted for.

Shaw admitted that from may 2018 through June 2018 he had altered and destroyed receipts and records from the Village of Waverly Recreation Department to cover up the $16,525 he had diverted.

As part of his plea, Shaw paid restitution to the Village and resigned from his position November 11, 2022.

In issuing a news release regarding the investigation, arrest, plea and sentencing, DiNapoli said "Mr. Shaw shamelessly altered records to cover up his misappropriation of money to support the children of his community for his own benefit."  DiNapoli thanked the Tioga County District Attorney, Kirk Martin and the New York State Police for working with his office on the case.

New York State Police Acting Superintendent Steven Nigrelli said the investigation should serve as a reminder that defrauding any amount will result in indictments and arrests.
