The grand jury reviewing evidence from the August 9th death of Kevin Ward, Jr. on the track at Canandaigua Motorsports Park has decided that Tony Stewart will not be charged in the death. The announcement was made this afternoon by prosecutors after the grand jury reached its conclusion.

The 20 year old Ward climbed from his car, during a dirt track race, after being wrecked by Tony Stewart and walked down the track to confront Stewart. Ward died from blunt force trauma.

According to Syracuse's ABC 9, Ontario County D.A. Michael Tantillo, a toxicology test on Kevin Ward showed he had marijuana in his system and it was a high enough level to show he was most likely impaired.

Tony Stewart could have been charged with second degree manslaughter if the grand jury had gone the other way.

After the horrific accident, NASCAR announced a rule that prohibits drivers from climbing out of a crashed or disabled vehicle -- unless it is on fire -- until safety personnel arrive.
