A Tioga County man is admitting he killed his eight-month-old daughter and tossed her into a swamp in the Town of Tioga in June of last year.

26-year-old Cody Franciscovich of Owego pleaded guilty in Tioga County Court August 14 to manslaughter in the death of the child who has become known as “Baby Ruby”. Tioga County District Attorney Kirk Martin announced the guilty plea this week.   

The baby was found face-down in a pond behind Saint Patrick’s Cemetery on June 9, 2019.  Her father was picked up a short time later by New York State Police, who found him naked on Route 17C near the Deep Well Motel where the man, his wife and children had been staying.

Cody Franciscovich said he had been taking LSD the night before the baby’s death. 

Allegations against Franciscovich over the course of the investigation included murder, manslaughter, rape and criminal sex acts although, according to a report in September, the man had never actually been charged with a sex crime. 

Tioga County District Attorney Kirk Martin announced the guilty plea this week.  The Owego man could receive a maximum of 25 years in prison followed by five years on probation. 

He is being held in the Tioga County Jail.
