LATEST: Windsor Man Killed in Gun Battle with State Trooper

State police say a 30-year-old man armed with a military-style rifle died after he exchanged gunfire with a trooper on Route 17 near Binghamton.

Authorities say Nicholas Philhower of Windsor was struck several times in the shootout in the town of Kirkwood just before 6:30 p.m. Monday.

Investigators say Trooper Timothy Conklin spotted a vehicle that reportedly was being used without permission.

The driver of the westbound car observed Conklin approaching at the Interstate 81 junction and traveled through the median before heading east on Route 17.

After the vehicle came to a stop moments later, police say Philhower opened on Conklin with the semi-automatic rifle.

The trooper returned fire through the windshield of his troop car as Philhower left the vehicle he had been driving. He moved toward Conklin and continued to fire at the trooper.

Conklin reloaded his weapon, left his car and continue to shoot at Philhower, who was struck several times. He was pronounced dead at the scene.

Investigators say Conklin, who has been a state trooper for 28 years, sustained a shrapnel injury to his upper right arm. He was treated at Wilson Medical Center in Johnson City and released.

Minutes before the deadly shooting, police had received a report that Philhower had taken his mother's vehicle without her permission. Officials say she had requested that he be located and arrested.

The state police investigation is continuing.
