98.1 The Hawk ‘Garth Brooks Biggest Fan’ Contest
Official Rules

A complete copy of these rules may be obtained at the offices of radio station WHWK-FM, owned and operated by Townsquare Media, 59 Court Street, Binghamton, NY 13905 during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address. The Station will conduct the WHWK-FM “Garth Brooks Biggest Fan” Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

1.Description of Contest/Participation.
a)Listeners will submit a photo or video through the WHWK-FM mobile app from Friday, January 27, 2017 until 9am on Monday, February 6, 2017. Any entries received out of this time frame will be disqualified. Photos and video must not contain any nudity or vulgarity. Videos should be no longer than 60 seconds in length. Any submission received and deemed to have inappropriate content will automatically be disqualified. All photos and videos must include participant’s first and last names, phone number with area code, date of birth, address, and a short description of why they are Garth Brooks’ biggest fan. Any photos/video that do not include those things will be automatically disqualified.

2.How to Enter.
a)Listeners must download free WHWK-FM mobile app by searching for ‘98.1 The Hawk’ in their app store. Using app, listeners must send a photo/video along with a short description of why they’re Garth Brooks’ Biggest Fan.

3.How Winners Are Selected.
b)Photo and video entries received between January 27, 2017 and February 6, 2017 will be placed on the WHWK-FM website by the morning of Tuesday, February 7, 2017. From February 7, 2017, through Friday, February 10, 2017, anyone who visits the WHWK-FM website will be able to vote for the entry they like the most. The top five entries with the most online votes will win tickets to see Garth Brooks at the Times Union Center in Albany on Saturday, March 11, 2017. Winners will be announced on Monday, February 13, 2017.

4. Technical Issues.
a)Should participating station or participant have a technical issue, including but not limited to, computer error, human error, and off-air transmitter difficulties resulting in entries not being received through the WHWK-FM app, Company and station will not be held responsible.

5.Prize(s).
a)The prize is a pair of tickets to see Garth Brooks at the Time Union Center in Albany on Saturday, March 11, 2017. Individual prize value is one hundred forty-nine dollars and ninety-six cents ($149.96). A total of FIVE (5) pair of tickets will be awarded. Approximate total value of all prizes is seven hundred forty-nine dollars and eighty cents ($749.80).

b)All prizes will be awarded. Potential winner must claim his/her prize from the Company at the participating Station awarding the prize, by the end of business day on Wednesday, March 1, 2017. If a winner cannot be contacted by Wednesday, March 1, 2017, fails to claim the prize by Wednesday, March 1, 2017, is deemed ineligible based on these Official Rules, or is disqualified, the winner forfeits the Prize and the Company reserves the right to determine an alternate winner at a time of its choosing prior to March 1, 2017, in its sole discretion. Prizes are not transferable or exchangeable for any other prize or equivalent prize.

6.Eligibility and Limitations.
a)Participants and winners must be legal U.S. residents at least 18 years old as determined by the Company and reside in a participating Station’s Total Survey Area (“TSA”) as defined by Arbitron (or the comparable market area or non-Arbitron markets). Company reserves the right to refuse to award a prize to a winner if a potential winner is determined to be ineligible or otherwise in violation of these Official Rules.

b)Winners are subject to a verification process to include winner’s name, address, home phone number, work/cell phone number, and social security number. Only one (1) prize per household for the Contest. Winners are eligible to win only once every thirty (30) days) in a Townsquare Media contest.

c)Employees of the Company, participating sponsors and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as in-laws or by current or past marriage(s), remarriage(s), adoption, co- habitation or other family extension, and any other persons residing at the same household whether or not related.

7.Delivery Disclaimer.
a)The Company disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery methods. Entries must be made as detailed herein.

b)The Company is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, the Internet or at any website or lost or unavailable network connections which may limit an entrant’s ability to participate in the Contest, and any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Contest.

8.Publicity; Use of Personal Information.
a)Unless prohibited by law, by participating in this Contest, all participants and winners grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with the promotion of this and other Contest and waive any claims to royalty, right, or remuneration for such use. By participating in the Contest, participants agree that the Company may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes on a worldwide basis in perpetuity.

8.Release.
a)By participating in the Contest, each participant and winner waives any and all claims of liability against the Company, its parent, related, affiliated and subsidiary companies and their employees and agents of each, for any personal injury or loss which may occur from the conduct of, or participation in, the Contest, or from the use of any prize. In order to receive a prize and to verify eligibility, participants must sign and return an Affidavit of Eligibility and Publicity Release form provided by the Company.

9.Taxes.
a)Any valuation of the prize(s) stated above is based on available.

b)information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes. Each winner must provide the Company with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded.

c)Prizes are not transferable, redeemable for cash or exchangeable for any other prize.

d)Any person winning over $600 in prizes from the Company will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

10.Conduct and Decisions.
a)By participating in the Contest, participants agree to be bound by the decisions of Company personnel, which are final with respect to this Contest.

b)Persons who violate any rule, gain an unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited.

c)The Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Company’s decisions concerning such disputes shall be final.

d)If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, the Company reserves the right to terminate the Contest, or make such other decisions regarding the outcome as the Company deems appropriate. All decisions will be made by the Company and are final. The Company may waive any of these rules in its sole discretion.

e)ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPATION TO THE FULLEST EXTENT PERMITTED BY LAW.

11.Miscellaneous.
a)No purchase necessary to participate or win. Void where prohibited. Odds of winning depend on the total number of entry votes received.

b)The Company may substitute prizes, amend the rules or discontinue the Contest at any time as announced on the Station. The Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Contest.

c)Written copies of these rules are available during normal business hours at the business offices of the Stations and by mail upon written request with a stamped, self-addressed envelope. All entries become the property of the Company and will not be returned. To be removed from our direct mail, email or fax lists, visit the main office of the Station during regular business hours or send a self-addressed, stamped envelope with Contest name to 59 Court Street, Binghamton, NY 13905.

12.Compliance with Law.
a)The conduct of the Contest is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein. Stations shall follow the applicable laws for conducting Contest, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Contest, etc. as required by local and state law.

13.List of winners.
a)For a list of winners from the Contest, send a self-addressed, stamped envelope with Contest name “Garth Brooks Contest Cash” to Townsquare Media, 59 Court Street, Binghamton, NY 13905 after Monday, February 13, 2017.
